TERMS OF SERVICE

1. Acceptance of Terms

By booking, entering, or using services at Dip Bathhouse (“Dip”, “we”, “us”, “our”), you (“guest”, “you”, “member”) agree to be bound by these Terms of Service, the Dip Bathhouse Cancellation & Rescheduling Policy, the Dip Bathhouse Privacy Policy, and the Client Entry Waiver, Release & Assumption of Risk (the “Waiver”) (together, the “Governing Documents”). If you do not agree to these Terms, you must not book, enter, or use our services.

Where a guest is also a member, the Membership Terms in Section 4 below apply in addition to these general Terms. Where there is a direct conflict between Section 4 and any other section of these Terms, Section 4 prevails in relation to membership-specific matters only.

2. Services

We provide bathhouse access and wellness services, including but not limited to:

• Hydrotherapy spas, steam room, and cedar and stone saunas
• Cold plunge facilities
• Curated soak experiences (including Essential, Splendour, and Afterglow)
• Relaxation massage and bodywork services (60-minute and 90-minute formats)

All services are provided for general wellness and relaxation purposes only. Nothing provided by Dip Bathhouse constitutes medical advice, diagnosis, or treatment, and our services are not a substitute for professional medical care.

Dip Bathhouse reserves the right to add, remove, modify, or substitute any service, facility, or offering at any time, with or without notice, including in response to maintenance, supply, staffing, or operational requirements.

3. Bookings

• Bookings may be made online or in person.
• Full payment or a deposit may be required to secure a booking.
• You are responsible for ensuring your booking details (including session type, date, time, and number of guests) are correct. Dip Bathhouse is not liable for any loss arising from incorrect information provided by you at the time of booking.
• Cancellations, rescheduling, late arrivals, and no-shows are governed by the Dip Bathhouse Cancellation & Rescheduling Policy, which forms part of these Terms.

4. Memberships

4.1 Membership Tiers

Dip Bathhouse offers the following membership tiers, each with its own pricing, term, and inclusions as published at the time of enrolment and confirmed in the guest’s membership agreement:

• FOUNDATION – a lifetime membership (referencing the lifetime of the membership tier itself, not the lifespan of the member), billed monthly.
• PALM – a flexible, month-to-month membership with no minimum lock-in period.
• OASIS – a 3-month unlimited membership, paid upfront for the full term.
• SPRINGS – a 6-month unlimited membership, paid upfront for the full term.

Specific inclusions for each tier (such as guest passes, complimentary massages, welcome packs, priority booking, and retail discounts) are set out in the current published membership schedule, which may be updated from time to time. Updates to inclusions will not reduce the inclusions of an existing member’s then-current billing or term period, but may apply to renewal periods or new enrolments.

4.2 Pricing and Rate Changes

Membership pricing reflects the rate published and agreed at the time of enrollment.

• For PALM (month-to-month) memberships, Dip Bathhouse may vary the monthly rate for future billing periods by providing at least 30 days’ written notice. Continued use of the membership after the notice period constitutes acceptance of the new rate. If the guest does not accept the new rate, they may cancel in accordance with the Cancellation Policy.
• For FOUNDATION members, the rate locked in at enrolment is held for the life of the FOUNDATION tier, and will not be increased for existing members, except where required by law or where the member upgrades, changes, or re-enrols in a different tier.
• For OASIS and SPRINGS, the upfront price paid covers the fixed term in full and will not change during that term.

4.3 Billing

• Monthly memberships (FOUNDATION, PALM) are billed automatically on a recurring basis to the guest’s nominated payment method.
• It is the guest’s responsibility to ensure their payment method remains valid and sufficiently funded. Failed payments may result in suspension of membership access until payment is successfully processed.
• Dip Bathhouse may charge a reasonable dishonour or failed-payment fee where a scheduled payment is declined or reversed by the guest’s financial institution.

4.4 Pausing, Cancellation, and Refunds

Pausing, cancellation, and refund terms for each membership tier are set out in full in the Dip Bathhouse Cancellation & Rescheduling Policy, which forms part of these Terms. In summary:

• FOUNDATION may be paused for up to 4 weeks per calendar year with 14 days’ notice, and may be cancelled with 14 days’ notice (no refund of fees already paid).
• PALM may be cancelled at any time with 14 days’ notice to avoid the next billing cycle. No partial-month refunds apply.
• OASIS and SPRINGS are non-refundable once the term has commenced, save for a discretionary pro-rata refund process described in the Cancellation Policy.

4.5 Membership Conduct and Suspension

Membership is personal to the individual named on the account and is non-transferable, except where a tier expressly includes transferable guest passes. Dip Bathhouse reserves the right to suspend or terminate a membership, without refund, where a member:

• Breaches these Terms, the Guest Etiquette standards in Section 8, or the Waiver;
• Shares, sells, or fraudulently uses their membership or guest passes; or
• Engages in conduct that, in Dip Bathhouse’s reasonable opinion, is harmful, abusive, or unsafe toward staff or other guests.

5. Entry Conditions

Entry to Dip Bathhouse is conditional upon:

• Acceptance and (where required) signing of the Waiver;
• Compliance with all Bathhouse rules, signage, and staff instructions; and
• Staff discretion to refuse entry where necessary, including where a guest appears intoxicated, unwell, or unable to safely participate.

Dip Bathhouse reserves the right to refuse entry or service to any person at its reasonable discretion, including for safety, capacity, or conduct reasons. Where entry is refused for reasons outside the guest’s control (for example, capacity constraints), Dip Bathhouse will offer a reschedule or refund at its discretion.

Guests under the age of 18 but not under the age of 16 (‘minors’) may enter or participate in Dip Bathhouse services where accompanied by a parent or legal guardian, and where that parent or legal guardian has signed the Waiver on the minor’s behalf in accordance with its terms. Guests under the age of 16 are not permitted entry to Dip Bathhouse under any circumstances.

6. Health, Safety and Contraindications

6.1 General

You agree to:

• Follow all safety instructions and signage;
• Take reasonable care for your own wellbeing; and
• Inform staff of any relevant health conditions prior to your session.

6.2 Contraindications

Heat and cold hydrotherapy (including saunas, steam rooms, and cold plunge facilities) is not suitable for everyone. By using these facilities, you confirm that you have considered, and where appropriate sought medical advice on, conditions including but not limited to:

• Pregnancy
• Cardiovascular conditions, including high or low blood pressure
• Epilepsy or seizure disorders
• Respiratory conditions
• Diabetes
• Being under the influence of alcohol or drugs

Dip Bathhouse staff are not medical professionals and do not provide medical clearance. It is the guest’s sole responsibility to determine, with their own medical practitioner if needed, whether use of our facilities is appropriate for them. Dip Bathhouse relies on the accuracy of information disclosed by guests and accepts no liability for non-disclosure.

6.3 Right to Decline Service

Dip Bathhouse staff may decline to provide a service, or may modify a service, where they reasonably believe it is unsafe to proceed.

7. Pricing

• Prices are subject to change without notice for casual, single-session bookings. Membership pricing changes are governed by Section 4.2.
• All prices are listed in AUD and include GST (where applicable).

8. Conduct and Etiquette

All guests must adhere to Dip Bathhouse’s etiquette standards. All guests are expected to:

• Respect personal space and the boundaries of other guests and staff;
• Use shared facilities mindfully and considerately; and
• Treat staff and other guests with courtesy.

The following behaviours are strictly prohibited and will result in immediate removal without refund, and may result in a permanent ban from Dip Bathhouse premises:

• Inappropriate or unwanted physical contact;
• Harassment, bullying, or discriminatory behaviour of any kind;
• Disruptive, intoxicated, or unsafe conduct; and
• Photography or filming of other guests without their explicit consent.

Dip Bathhouse reserves the right to involve relevant authorities where conduct may constitute a criminal offence.

Photography and recording within Dip Bathhouse premises is restricted and subject to staff approval. Full terms governing photography, recording, and use of guest images for marketing purposes are set out in the Waiver.

9. Liability

To the maximum extent permitted by law:

• Participation in any Dip Bathhouse service or use of any Dip Bathhouse facility is at your own risk.
• Dip Bathhouse is not liable for any injury, illness, loss, or damage arising from your use or misuse of our facilities, services, or premises, except to the extent such injury, illness, loss, or damage is caused by the negligence of Dip Bathhouse or its staff.
• Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable legislation. Where Dip Bathhouse’s liability cannot be excluded but may be limited, Dip Bathhouse’s liability is limited, at its option, to the resupply of the relevant service or the cost of resupplying that service.

10. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Dip Bathhouse, its owners, employees, and contractors against any claim, loss, liability, damage, or expense (including reasonable legal costs) arising from:

• Your breach of these Terms or the Waiver;
• Your negligent, reckless, or unlawful act or omission while on Dip Bathhouse premises; or
• Your failure to disclose a relevant health condition under Section 6.

This indemnity does not apply to the extent that the relevant claim, loss, liability, damage, or expense was caused by the negligence of Dip Bathhouse.

11. Personal Property

Guests are responsible for their own belongings while on Dip Bathhouse premises. To the extent permitted by law, Dip Bathhouse is not liable for the loss, theft, or damage of personal property.

12. Intellectual Property

All branding, logos, content, photography, and materials associated with Dip Bathhouse remain the property of Dip Bathhouse and may not be copied, reproduced, or used without prior written permission.

13. Privacy

Dip Bathhouse collects and handles personal information in accordance with the Dip Bathhouse Privacy Policy, which forms part of these Terms.

14. Dispute Resolution

If a dispute arises between a guest and Dip Bathhouse in connection with these Terms or any service provided, the parties agree to first attempt to resolve the dispute informally by contacting Dip Bathhouse directly at [email protected]. If the dispute is not resolved within a reasonable time, either party may pursue any right or remedy available to them at law, including through a relevant Australian court, tribunal, or ombudsman scheme.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia. Each party submits to the exclusive jurisdiction of the courts of Queensland in relation to any dispute arising from these Terms.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

17. Changes to Terms

Dip Bathhouse may update these Terms at any time. The version published on our website applies from the date it is published. Continued use of our services following a published update constitutes acceptance of the updated Terms. Material changes affecting membership pricing or core inclusions will, where required by Section 4.2, be separately notified to affected members.
