Assumption of Risk
I acknowledge and understand that participation in services and facilities at Dip Bathhouse (“the Bathhouse”) involves inherent risks, including but not limited to:
- Slips, trips, and falls on wet or uneven surfaces
- Exposure to hot, cold, steam, or fluctuating temperatures
- Dizziness, fainting, dehydration, or changes in blood pressure
- Muscle soreness, bruising, or strain
- Risks associated with massage, bodywork, or wellness treatments
- Risks arising from other patrons’ conduct or use of facilities
I voluntarily assume all risks, whether known or unknown, arising from my participation.
Medical Declaration & Fitness to Participate
I declare that:
- I am in good health and physically able to participate in bathhouse and wellness activities.
- I have disclosed all relevant medical conditions, injuries, pregnancies, or medications that may affect my participation.
- I understand that services provided are not medical treatments, diagnostics, or rehabilitation services.
- I acknowledge that it is my responsibility to consult a medical professional if unsure about my fitness to participate.
I specifically acknowledge that heat and cold hydrotherapy (including saunas, steam rooms, and cold plunge facilities) carries particular risk for guests with the following conditions, and that I have considered, and where appropriate sought medical advice on, whether participation is appropriate for me in light of:
- Pregnancy
- Cardiovascular conditions, including high or low blood pressure
- Epilepsy or seizure disorders
- Respiratory conditions
- Diabetes
- Being under the influence of alcohol or drugs
I understand that Bathhouse staff are not medical professionals, do not provide medical clearance, and rely entirely on the accuracy and completeness of the information I disclose.
Massage & Bodywork Consent
I understand and agree that:
- Massage and bodywork services are provided for relaxation and general wellness purposes only.
- Therapists do not diagnose, prescribe, or treat medical conditions.
- I must communicate discomfort, pain, or boundaries immediately during treatment.
I release the Bathhouse and its practitioners from liability arising from normal and reasonable massage practice, except to the extent such liability cannot be excluded under the Australian Consumer Law or other applicable legislation.
Slips, Trips & Falls Disclaimer
I acknowledge that water, steam, oils, and other substances may create slippery conditions. I agree to:
- Move carefully and responsibly within all wet areas;
- Follow all signage, staff instructions, and safety guidelines; and
- Accept responsibility for my own actions and movements.
Photography & Recording Policy
I understand and agree that:
- Photography or video recording may be restricted within certain areas of the Bathhouse to protect privacy.
- Any photography permitted is subject to staff approval.
- I will not capture images of other patrons or staff without their explicit consent.
Where photography or recording is permitted, I grant the Bathhouse permission to use images in which I may appear for marketing, promotional, or documentation purposes, unless I have opted out in writing.
Personal Property
I acknowledge that the Bathhouse is not responsible for loss, theft, or damage to personal belongings brought onto the premises, including valuables.
Guest Etiquette & Conduct
To ensure a safe, respectful, and inclusive environment for all guests, I agree to the following while on the premises of Dip Bathhouse:
I will:
- Treat all guests and staff with courtesy, respect, and consideration;
- Respect personal space, privacy, and boundaries at all times;
- Use shared facilities mindfully and in accordance with posted guidelines; and
- Maintain appropriate behaviour within communal and private areas.
I understand that the following behaviours are not permitted:
- Inappropriate touching, sexualised behaviour, or unwanted physical contact;
- Harassment, bullying, intimidation, or discriminatory conduct of any kind;
- Body shaming, verbal abuse, or offensive language; and
- Disruptive behaviour that impacts the comfort or safety of others.
Minors
Where a guest under the age of 18, but not under the age of 16 (“minor”), is permitted entry to the Bathhouse accompanied by a parent or legal guardian, that parent or legal guardian must sign this Waiver on the minor’s behalf prior to the minor’s entry. Guests under the age of 16 are not permitted entry to the Bathhouse under any circumstances. By signing on a minor’s behalf, the parent or legal guardian:
- Confirms they have legal authority to do so;
- Accepts this Waiver in full on the minor’s behalf, including the assumption of risk, medical declaration, and release of liability; and
- Accepts responsibility for the minor’s conduct while on Bathhouse premises.
Release & Limitation of Liability
To the fullest extent permitted by law, I:
- Release, waive, and discharge Dip Bathhouse, its owners, employees, contractors, and agents from any claims, demands, or causes of action arising from my participation; and
- Agree that this release applies to claims arising from negligence, except to the extent such liability cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable legislation.
Nothing in this Waiver excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded.
Compliance with Rules & Staff Directions
I agree to comply with all Bathhouse rules, policies, signage, and staff instructions. I understand that failure to do so may result in removal from the premises without refund.
Severability
If any provision of this Waiver is found to be invalid, illegal, or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
Governing Law
This agreement is governed by the laws of Queensland, Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.
Electronic Execution
This Waiver is signed and accepted electronically. By submitting this form (including by ticking a checkbox, typing your name, or clicking ‘I agree’ or an equivalent confirmation step), you confirm that:
- You intend your electronic action to constitute your legally binding signature and acceptance of this Waiver;
- You have read and understood the Waiver in full prior to accepting it; and
- Where you are signing on behalf of a minor, you have the legal authority to do so, and your electronic acceptance binds you as the minor’s parent or legal guardian in accordance with the Minors section above.
Dip Bathhouse retains a record of each electronic acceptance, including the name entered, the date and time of acceptance, and the version of this Waiver accepted.
Acknowledgement
You will be asked to sign this waiver before arrival.
